Privacy Policy & User Data Agreement for Welligo
Effective Date: February 1st, 2026
1. Acceptance through Use (No-Popup Notice)
By accessing www.welligo.in or the Welligo App, you acknowledge and agree that your continued use of our platforms constitutes deemed consent under the Digital Personal Data Protection Act (DPDP), 2023. If you do not agree to these terms, you must immediately cease usage of the website and application.
2. Information Collection & Business Discretion
Welligo collects personal, device, and behavioral data. We reserve the right to collect and analyze non-personal metadata (browsing patterns, device IDs) without further notice to the user to improve business operations and fraud detection.
3. Limitation of Liability (The “Safe Harbor” Clause)
While Welligo Enterprise (OPC) Pvt Ltd uses industry-standard encryption, Welligo shall not be held liable for:
- Data Breaches: Any unauthorized access resulting from factors beyond our direct control (e.g., third-party server hacks or user-end malware).
- Third-Party Actions: Actions of independent contractors, courier partners, or payment gateways. Users are encouraged to read the NPCI Privacy Guidelines for UPI/Banking transactions.
4. Broad Data Sharing Rights
To ensure seamless operation from Pithoragarh, the user grants Welligo a royalty-free, worldwide license to use, store, and share data with:
- Service Providers: Logistics, marketing, and cloud storage partners.
- Business Transfers: In the event of a merger, sale, or restructuring of Welligo.
- Legal Compliance: Without prior user notification, to any government authority under the Information Technology Act, 2000.
5. “As-Is” Data Accuracy
The responsibility for the accuracy of data lies solely with the user. Welligo is under no obligation to verify the identity of any user and shall be indemnified by the user against any claims arising from incorrect delivery addresses or fraudulent payment details provided by the user.
6. Strict Retention & Deletion Policy
Welligo will retain user data for as long as deemed necessary for business purposes and legal record-keeping. Requesting “Data Deletion” is subject to Welligo verification process and statutory requirements (GST/Tax audits), which may take up to 90 days to process.
7. Indemnification
The user agrees to indemnify, defend, and hold harmless Welligo and Welligo Enterprise (OPC) Pvt Ltd from any claims, damages, or legal expenses arising from the user’s violation of this policy or misuse of the platform.
8. Modification Power
Welligo reserves the unilateral right to modify this policy at any time. Updates will be posted on this URL. It is the user’s sole responsibility to check for updates; continued use after changes constitutes acceptance.
9. Grievance & Dispute Resolution
In compliance with the Consumer Protection (E-Commerce) Rules, 2020, any complaints must be sent to the Grievance Officer.
Jurisdiction: All legal matters are strictly subject to the courts of Pithoragarh, Uttarakhand only.
